Case Background

This web site provides information about a collective action lawsuit for unpaid overtime against Group O, Inc. pursuant to the Fair Labor Standards Act (“FLSA”) brought by current and former employees who worked for Group O in Illinois  at Caterpillar’s Joliet plant.

The case was originally filed by three former employees of Group O in U.S.  District Court for the Northern District of Illinois on June 10, 2013. Plaintiffs allege that Group O did not pay employees overtime for all hours in excess of forty (40) per workweek because they performed work that was unpaid.  This unpaid work includes time worked during an otherwise unpaid 30 minute lunch break and time worked but left off of the employees’ time records due to Group O’s practice of rounding employees’ swipe-in and swipe-out times in a manner that benefited Group O, Inc. but not the employees.

The Plaintiff filed a motion requesting the Court to conditionally certify the lawsuit as a “collective action” which is a type of lawsuit that may be maintained by one or more employees for an on behalf of themselves and all other current and former employees who are “similarly situated.” No employee, however, may be a plaintiff, however, unless he or she is eligible based on the definition approved by the Court, and the individual gives his or her consent in writing to become a party, and that consent is timely filed with the Court.

On November 12, 2013, Northern District of Illinois Court ordered Group O, Inc. to post this NOTICE in Caterpillar’s Joliet, Illinois Plant advising its employees of an overtime and wage violation lawsuit brought by some of Group O’s employees represented by the law firm of Asonye and Associates. The complaint alleges that Group O, Inc. failed to compensate employees for time worked during lunch periods and for time worked but left off of the employees’ time records due to Group O’s practice of rounding employees’ swipe-in and swipe-out times.  Eligible current and former employees can join the collective action by filling out and submitting the attached CONSENT form to Asonye and Associates.

The deadline to return the Consent form to Asonye and Associates is January 14, 2014.
